Welcome to NSIOY! This website and online store are operated by NSIOY LLC, doing business as NSIOY. Throughout these Terms, the words “we,” “us,” and “our” refer to NSIOY LLC.

NSIOY operates this store and website, including all related information, content, features, tools, products, and services, to provide customers with a curated online shopping experience collectively referred to as the “Services.”

NSIOY is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when using the Services.

Please read these Terms carefully. They include important information about your legal rights, warranty disclaimers, and limitations of liability.

By visiting, interacting with, or using the Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not access or use the Services.

SECTION 1 — ACCESS AND ACCOUNTS

By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence, or that you have given consent for any minor dependents to use the Services on devices you own, purchase, or manage.

To use the Services, including browsing our online store or purchasing products, you may be asked to provide information such as your email address, billing information, payment information, and shipping address.

You represent and warrant that all information you provide is accurate, current, and complete and that you have the legal right to provide it.

You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account. You may not transfer, sell, assign, or license your account to another person.

SECTION 2 — OUR PRODUCTS

NSIOY sells original, sports-themed, print-on-demand apparel, drinkware, and accessories.

Our products may include T-shirts, sweatshirts, hoodies, hats, coffee mugs, and other merchandise.

Made-to-order production

Products are produced specifically after an order is placed. We generally do not maintain finished-product inventory.

Products may be manufactured, printed, packaged, and shipped by independent third-party print-on-demand production and fulfillment providers.

Because products are made to order, correctly produced items are not eligible for returns, exchanges, refunds, or complimentary replacements because of:

Incorrect sizing selected by the customer
Fit or comfort preferences
Color or style preferences
Change of mind
Buyer’s remorse
An incorrect product variation selected by the customer

Please carefully review product descriptions, size charts, colors, styles, quantities, and other selections before submitting an order.

Purchases are subject to our Refund and Return Policy.

Product images and variations

We make reasonable efforts to display our products accurately. However, product photographs and mockups are digital representations.

Actual colors and product appearance may vary because of:

Screen and device settings
Lighting conditions
Fabric or material differences
Garment construction
Printing methods
Normal production tolerances

Minor differences in color, texture, print placement, sizing measurements, or overall appearance that do not materially impair the product are not considered defects.

We do not guarantee that a product’s appearance, fit, or subjective quality will meet every customer’s personal expectations.

Product descriptions, prices, designs, materials, colors, and available variants may change without notice.

We reserve the right to discontinue products or limit quantities offered to any person, geographic region, or jurisdiction.

SECTION 3 — ORDERS

When you submit an order, you are making an offer to purchase.

NSIOY reserves the right to accept, reject, limit, or cancel an order for any lawful reason, including:

Suspected fraud or unauthorized payment
Product or production unavailability
Incorrect pricing or product information
Shipping restrictions
An incomplete or undeliverable address
Apparent commercial resale
Violation of these Terms

Your order is not accepted until payment has been successfully processed and the order has been accepted for fulfillment.

Please review your order carefully before submitting it.

You are responsible for confirming:

Size
Color
Style
Quantity
Personalization, when applicable
Billing information
Shipping address
Contact information

Orders may enter production shortly after being placed. Changes, cancellations, and address corrections are not guaranteed.

Once an order has entered production, it generally cannot be canceled, edited, exchanged, or refunded.

If we reject, modify, or cancel an order, we will attempt to notify you using the email address, billing address, or phone number provided at checkout.

If we cancel an order after payment has been collected, we will refund the amount charged for the canceled portion of the order.

Purchases are subject exclusively to our Refund and Return Policy.

You represent that purchases are for personal or household use and not for unauthorized commercial resale or export.

SECTION 4 — PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice.

The price charged will generally be the price displayed when the order is placed and shown in the order confirmation.

Unless otherwise stated, listed prices do not include applicable:

Sales taxes
Shipping charges
Handling charges
Customs duties
Import fees

Promotions may have separate terms. If promotional terms conflict with these Terms, the promotional terms govern for that promotion.

You agree to provide accurate and complete payment, billing, account, and contact information.

You represent and warrant that:

The payment information you provide is accurate and complete.
You are authorized to use the payment method.
Charges will be honored by your payment provider.
You will pay all applicable product, tax, shipping, and handling charges.

We reserve the right to correct pricing, discount, product, or billing errors.

If an error affects an order already submitted, we may contact you for approval, cancel the affected item, or issue a refund.

SECTION 5 — SHIPPING AND DELIVERY

Production and delivery dates are estimates only and are not guaranteed.

Products in the same order may be produced by different fulfillment providers. As a result, items may arrive:

In separate packages
On different dates
Through different shipping carriers

We are not responsible for delays caused by:

Shipping carriers
Weather
Holidays
Customs processing
Labor disruptions
Supply shortages
Government actions
Incorrect addresses
Events outside our reasonable control

Customer-provided addresses

You are responsible for providing a complete and accurate shipping address.

NSIOY is not responsible for orders delayed, misdelivered, returned, lost, or made undeliverable because of an incorrect or incomplete address supplied by the customer.

If an order must be reproduced or reshipped because of customer-provided information, the customer may be required to pay all additional production and shipping costs.

Address changes are not guaranteed after an order has been placed and generally cannot be made after production or shipment begins.

Delivery estimates

A missed estimated delivery date does not automatically qualify an order for cancellation, refund, replacement, or reimbursement.

If tracking indicates that a package was delivered, the customer may be required to:

Check with household members
Check nearby entrances or delivery locations
Contact neighbors or property management
Contact the shipping carrier
Allow a reasonable period for delayed carrier scanning

Lost, damaged, delayed, or delivered-package claims will be reviewed individually under our Shipping Policy and Refund and Return Policy.

Once products are transferred to the carrier, title and risk of loss pass to the customer to the extent permitted by applicable law.

SECTION 6 — RETURNS, REFUNDS, AND CLAIMS

All sales are final except as expressly provided in our Refund and Return Policy or required by applicable law.

We do not accept ordinary returns or exchanges for correctly produced made-to-order products.

Eligible claims generally are limited to products that arrive:

Damaged
Defective
Materially misprinted
Materially different from the product ordered
Incorrect because of a fulfillment error

Claims must be submitted within the time stated in our Refund and Return Policy and must include all requested documentation.

We may require:

The order number
A written description of the problem
Photographs of the entire product
Close-up photographs of the reported issue
A photograph of the size or product label
A photograph of the packaging or shipping label

Submitting a claim does not automatically guarantee a refund, replacement, or other resolution.

NSIOY will review the documentation and determine the appropriate remedy, which may include:

Replacement
Refund
Partial refund
Store credit
Denial of the claim

Customers must not mail products to NSIOY, Shopify, Printify, or any fulfillment provider unless NSIOY provides written return authorization and instructions.

Unauthorized returns may be refused and will not automatically qualify for a refund.

SECTION 7 — INTELLECTUAL PROPERTY

The Services and their contents, including trademarks, trade names, logos, slogans, graphics, product designs, artwork, photographs, text, video, audio, layouts, and other materials, are owned by or licensed to NSIOY LLC and are protected by applicable intellectual-property laws.

These Terms permit personal, noncommercial use of the Services only.

Without prior written permission, you may not:

Copy
Reproduce
Modify
Distribute
Manufacture
Republish
Download
Store
Transmit
Display
Sell
License
Commercially exploit

any NSIOY design, artwork, slogan, logo, product image, website content, or other protected material.

Purchasing a product does not transfer ownership of any intellectual-property rights appearing on that product.

“NSIOY,” the NSIOY logo, and related product names, designs, and slogans are trademarks or intellectual property of NSIOY LLC or its licensors.

Shopify’s names, logos, product names, and slogans are trademarks of Shopify.

All other trademarks belong to their respective owners.

SECTION 8 — OPTIONAL TOOLS

We may provide access to third-party tools that we do not monitor or control.

Access to these tools is provided “as is” and “as available,” without warranties, representations, conditions, or endorsements.

We are not liable for damages arising from your use of optional third-party tools.

Your use of any optional tool is at your own risk. You are responsible for reviewing and accepting the third party’s applicable terms and policies.

Future features, tools, or resources offered through the Services will also be governed by these Terms.

SECTION 9 — THIRD-PARTY LINKS AND SERVICES

The Services may include links, materials, embedded functions, or services provided by third parties.

We are not responsible for examining or evaluating the content, accuracy, practices, or security of third-party websites or services.

Accessing a third-party website or service is at your own risk.

We are not responsible for harm, loss, or damages arising from third-party products, services, websites, content, or transactions.

You should review the third party’s policies before completing a transaction.

Complaints regarding third-party products or services should be directed to the applicable third party.

SECTION 10 — RELATIONSHIP WITH SHOPIFY

NSIOY is powered by Shopify, which enables us to provide the Services to you.

However, any sales and purchases made through our store are made directly between you and NSIOY.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and NSIOY, including any injury, damage, loss, refund, return, delivery problem, or dispute arising from purchased products or services.

You expressly release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases and transactions with NSIOY.

SECTION 11 — PRIVACY POLICY

Personal information collected through the Services is governed by our Privacy Policy, available through the Privacy Policy link on our website.

Certain personal information may also be subject to Shopify’s Privacy Policy.

Because Shopify hosts the Services, Shopify collects and processes information relating to your access to and use of the Services.

Information submitted through the Services may be transmitted to Shopify and other service providers, including providers located outside your country of residence, as necessary to operate the Services.

SECTION 12 — FEEDBACK, REVIEWS, AND SUBMISSIONS

If you submit reviews, photographs, comments, ideas, suggestions, proposals, plans, or other content, collectively referred to as “Feedback,” you grant NSIOY a perpetual, worldwide, sublicensable, royalty-free license to:

that Feedback in any medium for lawful business and promotional purposes.

You represent that:

You own or have permission to submit the Feedback.
The Feedback does not infringe another person’s rights.
Any compensation or incentive associated with the Feedback has been disclosed.

We are not obligated to:

Keep Feedback confidential
Pay compensation
Publish Feedback
Respond to Feedback

We may monitor, edit, decline, or remove Feedback that we determine is unlawful, misleading, abusive, obscene, defamatory, infringing, or otherwise objectionable.

You may not use a false identity or misleading email address or misrepresent the origin of Feedback.

You are responsible for the accuracy and legality of content you submit.

We reserve the right to correct errors, update information, modify products, or cancel orders when information is inaccurate, including after an order has been submitted.

SECTION 15 — AUTOMATED AGENTS

This section applies when you use or deploy an automated or semi-automated software agent to access or interact with the Services.

An “Agent” means software or a service that takes autonomous or semi-autonomous action on behalf of a person or entity.

Agents may not access or interact with the Services unless they:

Accurately identify themselves as automated agents.
Comply with all technical and access requirements established by us.
Do not conceal their automated nature.
Do not mimic human behavior for purposes of evading detection.
Do not complete or circumvent CAPTCHAs or similar safeguards.
Do not bypass restrictions on automated access.

We may limit or block Agent access through technical or other measures.

We may terminate these Terms or suspend access to all or part of the Services at our discretion when permitted by law.

You remain responsible for amounts incurred before termination.

Sections relating to intellectual property, Feedback, disclaimers, liability, indemnification, governing law, and other provisions that by their nature should survive termination will remain effective.

SECTION 17 — DISCLAIMER OF WARRANTIES

Information made available through the Services is provided for general informational purposes.

We do not warrant that all information will be accurate, complete, current, or suitable for every purpose.

We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free.

Nothing in these Terms excludes rights or warranties that cannot lawfully be excluded.

SECTION 18 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, NSIOY LLC and its owners, officers, employees, affiliates, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from:

Inability to use the Services
Products purchased through the Services
Errors or omissions in content
Shipping delays
Loss of data
Lost profits
Lost revenue
Replacement costs

Where liability cannot be legally excluded, NSIOY’s total liability relating to an order will not exceed the amount paid for the product giving rise to the claim, except where applicable law requires otherwise.

Nothing in this section excludes or limits liability that cannot legally be excluded or limited.

SECTION 19 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify, defend, and hold harmless NSIOY LLC, Shopify, and their respective affiliates, owners, officers, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, damages, and reasonable legal expenses arising from:

Your breach of these Terms.
Your violation of applicable law.
Your violation of another person’s rights.
Your unlawful or unauthorized use of the Services.

We will provide reasonable notice of an indemnifiable claim.

We may control the defense and settlement of the claim at your expense, but we will not agree to a settlement requiring nonmonetary obligations from you without your consent, which must not be unreasonably withheld.

You agree to reasonably cooperate in the defense of the claim.

If any provision of these Terms is found to be unlawful, void, or unenforceable, the provision will be enforced to the maximum extent permitted by law.

Any unenforceable portion will be severed without affecting the validity of the remaining provisions.

Our failure to enforce a provision does not waive our right to enforce it later.

These Terms, together with any policies or operating rules posted through the Services, constitute the entire agreement between you and NSIOY relating to use of the Services.

They supersede prior or contemporaneous communications, agreements, representations, or proposals relating to the Services.

SECTION 22 — ASSIGNMENT

You may not assign, transfer, delegate, or license your rights or obligations under these Terms without our prior written consent.

Any attempted assignment without permission is void.

We may assign or transfer these Terms and our rights and obligations as permitted by law.

SECTION 23 — GOVERNING LAW

These Terms and any separate agreements through which we provide Services are governed by the laws of the State of Michigan and applicable federal law, without regard to conflict-of-law principles.

Subject to any rights that cannot be waived under applicable consumer law, you and NSIOY consent to the jurisdiction of courts having proper jurisdiction in Michigan.

Section headings are included for convenience only and do not limit or affect the meaning of these Terms.

You may review the current version of these Terms at any time on this page.

We reserve the right to update, modify, or replace these Terms by posting a revised version through the Services.

Material changes will be communicated when required by applicable law.

Changes become effective on the date stated in the updated Terms.

Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
